Dumped Waste – Owner Fined in Court

Council wins court case over resident’s failure to prevent pests from dumped waste.

Miss Angel Robertson of Thorn Bank, Bacup, left settees and a fridge in the front garden, leading to complaints from neighbours at the environmental issues this was causing. The court ordered that she is to be fined £660 and ordered to pay £314.68 costs and £77.65 compensation in her absence. This was for failure to adhere to a Section 4 Notice from the Prevention of Damage by Pests Act 1949.

Miss Roberston was given two verbal warnings and a notice following the complaint, which were ignored, as such we cleared the settees and fridge as work in default which then lead to the prosecution in court. The cost to the public purse on issues such as this is large and the court fine reflects this.

Enforcement Officers at the Council do take dumped waste seriously and will take necessary measures to ensure that people do not dump waste causing environmental issues for their neighbours and the area they live in.
